Concept Note

Human rights are rights inherent to all human beings, whatever our nationality, place of residence, sex, ethnic origin, colour, religion, language, or any other status. These rights are all interrelated, interdependent and indivisible. The Constitution of India under Part III ensures fundamental right not only to Citizen of India but any person within the India. The Fundamental rights under the Indian constitution are basically Human Right in Nature. Human rights entail both rights and obligations. State assume obligations and duties not only under international law but also under constitution to respect and protect and to fulfill human rights. The obligation on the State is to take positive action to facilitate the enjoyment of basic human rights.
The criminal justice system is the set of norms and agencies followed by procedure by which a criminal undergoes and is punished accordingly, however, even being an accused or criminal a person enjoys certain human right and other rights. If we see historically then we find that concept of the punishment has changed over period of time influenced by legal notions such as concept of justice, concept of fair trial, theory of punishment, recognition of human rights.
There are certain measures adopted by the legal system for the protection of the accused. There are certain legal theories established overtime for protection of the accused, such as Eiincumbit probatio, qui dicit non qui negat; cum per rerum naturam factum negantis probatio nulla sit. The general concept of the law is that the person is innocent until proved otherwise. Thus till the end of trial process accused basic rights should be protected and if he has been proved guilty of the offence he must be treated in a humane manner.

Call for Chapters

The aim of the proposed book is to study the relationship between the human rights and the Criminal justice administration and correlate the present notions of Criminal Justice in the society which is the need of the hour today. The book would further enumerate the haphazard interplay between the ideal Criminal Justice Process and the administration of criminal justice by the state. The purpose of this book is to explore the discrepancies and violations of Human Rights / Prisoners Rights / Rights of the accused persons in the Criminal Justice system in India.

Submission Guidelines
Chapter: Chapter should be in Times New Roman 12 point font and double spaced.
Main title should be in full capitals, bold and centered with a 12 point font.
Sub-titles should be in sentence case, bold and 12 point font.
Author’s names should be in Capitals and centered 12 point font
Footnotes should be in Times New Roman 10 point font.

Citation Format: Footnotes should be in conformity with bluebook 20th edition, which is attached with the notification.
Submission of the abstract: A covering letter with the name(s) of the author(s) and address, designation, institution/affiliation, the title of the manuscript and contact information (email, phone, etc.) is compulsory to submit. All submissions must contain an abstract of not more than 300 words.
Originality of Manuscripts: All the contributions should be the original work of the contributors and should not have been submitted for consideration in any other Publication. Any plagiarized work will be out-rightly rejected.

Copyright: The contributions presented to and accepted for publication and the copyrights therein shall be the intellectual property of the Publisher.

Guidelines for Chapter Submission

The title of the Chapter should be followed by Name, Designation, Name of the Organization/University/Institution and Email address.
It is mandatory to mention Email address for future correspondence.
Mention the Name and details of the Co-author, if applicable.
The chapter should be typed in MS WORD format (preferably 2007 or 2010).
The chapter must be in single column layout with margins justified on both sides.
The length of chapter should be in between 3500 to 7,000 words (including footnotes).
Exceeding the word limit may lead to rejection.
All accepted Chapters will be published in Book bearing ISBN.

  • Final chapter submission:- 30 July 2021

Professor (Dr.) Kavita Singh: Dr. Kavita Singh has more than 18 years teaching experience, before joining NUJS she has taught at the Dept. of Law, University of North Bengal and S.K. Acharaya Institute of Law, Kalyani University as lecturer among other places. Her research interests include Criminal Law, Criminology & Victimology and Family Law.

Mr. Amish Abdullah: Mr. Amish Abdullah is a faculty of law working at the post of Assistant Professor at Symbiosis Law School Hyderabad. He is an advocate, member of Bar Council of Delhi, who practiced law in the Supreme Court of India and Delhi High Court.
