Project Details :
This project analyzes the mutual interactions that exist
between (i) traditional institutional paradigms used in
comparative public law studies (especially regarding the form
of government); (ii) their reaction to emergencies; (iii) and the
use of technology as a tool to respond to crises – something
which strongly characterized recent years. More in detail, the
project starts from three main assumptions. First, it is very
well known that the role of executives is naturally enhanced
in time of emergencies, and this happens even in those
systems of government – such as some parliamentarisms –
where there is normally a more balanced dynamic between
executives and other state bodies (especially parliaments).
Second, in recent emergencies, technology – even in its
advanced forms, such as artificial intelligence – came up as a
powerful ally to react to the crisis. Third, executives, being
the most involved actors during crises, often took the lead in
managing the policy and legal framework to make the use of
such technology possible.
The combination of these three approaches may bring
significant implications in terms of institutional balance, since,
on the one hand, executives may take these policy choices with
no or poor involvement of legislative assemblies, and, on the
other hand, they frequently engage in forms of cooperation with
“technology giants” that may impact the very concept of “public
power”.
