Recreational use of organic drugs to herbs – illegal to legal?

Introduction

This article presents a comprehensive argument for the group effect of organic mind-altering drugs. The anti-drug order is described because of physical violence against those involved in non-violent behavior, and voluntary illegal drug transactions and legalization is defined as more or less abolition of such violence, depending on the legality included in the country.

The purpose of drug legislation is to prevent drug users from harming themselves or others. People suspected of violating illegal drug laws (“suspected of taking drugs”) were arrested using force, including the use of guns, and brought to justice. ​In any analysis and consideration of the ban, the four hazards related to the use of illegal drugs must be separated. In the

These categories are:

(1)Damage caused by a prohibition;

 (2) Preventing damage;

 (3) Prohibiting not prevented damage;

 (4) Damage caused by exposure to drugs but not caused by drugs.

Approach to the issue:

Some main reasons help prohibit or contrast morality and practice. The “ban” supports drug control because they recognize that drug use is immoral, and the country must implement this moral rule. “Most people who are morally opposed to legalization also admit that they will bring more problems than they solve.

Anyone who takes a moral stand against collective action must prove three statements:

1. Drug use is immoral;

2. the government has the right to prohibit unethical behavior, even if such behavior does not directly harm others;

3. The government takes effective action and will not cause more severe problems than drug abuse itself. Legalization advocates (“Legalizers”) are divided into different groups.

Delhi is the third largest client of weed within the world than New York and Karachi.[1]. I believe there’s no alternative country like Asian countries where weed has been an integral part of faith and society. Heaps of analysis paper recommend that the medical advantages of marijuana may be used as a treatment against psychopathy and anxiety. Delhi consumes 38,260-kilo marijuana per annum. Mumbai is sixth in the ranking that consumes 32,380 kg each year, and every one of these is often illegitimate in India.[2]. If India lets weed, then our government can earn a lot of revenue which could help in boosting our GDP. In Artha Veda, weed is delineated as one thing that brings joy.

Lord Shiva is generally seen with a chillum. Most of the sadhus communicate with God via communal smoking sessions. Soft drugs could be a necessary drink on Holi, and Shivaratri bhang is one in every strain of cannabis. So, cannabis and varied derivatives are illegitimate in our country solely since 1985; with the passing of the narcotics and psychotropic substances act, this happened due to 2 reasons:

  • First was our commitment to a global written agreement on narcotics.
  • The second was the pressure by the United States of America to be explicit within their war on drugs.

There have been many cases and PIL filed in a lot of countries for the legalization or decriminalization of the use of cannabis. In the case of- R vs. Parker[3]This was the leading medical case to bring down the prohibition on marijuana in Canada. Terrance Parker, an epileptic patient, was prescribed marijuana by his physician with his other medicines. Since it was not legally available in Canada, he began cultivating the plant at his place and was caught by the police and charged under the law. In the trial, it was proved that Parker experienced fewer seizures when he consumed marijuana and had a legal excuse for using the same. After this, the trial court judge legalized marijuana consumption for medical purposes only.

It was also argued that cannabis was legalized in several countries for both medical and recreational purposes. With the help of Canadian doctors, it was said that cannabis oil was used as a treatment for cancer. The Delhi High Court had dismissed this PIL. The 2-judicial bench of Justice D.N. Patel and Justice C. Hari Shankar stated that the legalization of cannabis for medical purposes could only be done by the Central Government.

Conclusion:

Cannabis is legal in 29 states in America, and in 8 states, it can be purchased by anyone older than 21 years. Latin American countries do not always have such strict drug laws. The existing drug laws do not fully distinguish between low-level and high-level drug crimes, nor do they distinguish between types of drugs; in general, the penalties for all drug users are relatively severe.[4].
